Our lawyer Ednaldo Almeida took part in an article in the magazine Consultor Jurídico (ConJur), which dealt with a decision by the STJ, which confirmed the modulation of the temporal effects of the thesis that removed the ceiling of 20 minimum wages for the calculation basis of parafiscal contributions aimed at funding the S System (Sesi, Senai, Sesc and Senac).
This means that these companies could continue to pay the contribution with a limit of 20 minimum wages, but only until May 2, 2024, the date on which the 1st Section’s ruling was published. From that date, the limit will no longer apply to everyone. For the tax expert, there is a competition problem. “Taxpayers in the same economic segment now have absolutely different tax burdens, just because one obtained a favorable court decision and the other did not.”
