The CVM’s decision about the distribution of dividends of the Maxi Renda real estate fund (MXRF11) surprised the market. The autarchy requested that the FII start distributing dividends to shareholders only when there is accounting profit and not on the cash basis.
Our lawyer Raphael Pires commented on the issue in reports by Suno and Inteligência Financeira. According to him, there are chances of a revision of the decision and the understanding would only be valid for other real estate funds if the CVM releases a new official letter with this determination.
“The big problem is the vagueness of the legislation. The ideal way to solve the problem in the most correct way possible is to put a rule, define the issue with the legislator”, he says.
